دور السلطة التشريعية في رسم السياسة الخارجية : دراسة حالة الجزائر 1989 - 2015

Abstract

إن الدور المحوري والأساسي للسلطة التنفيذية في رسم السياسية الخارجية لا ينفي دور السلطة التشريعية في الرقابة على هذا المجال الحيوي والحساس والتأثير فيه بهدف تحقيق أهداف السياسة الخارجية وترقيتها خدمة للمصلحة العليا للدولة. فالسلطة التشريعية كمؤسسة رسمية من مؤسسات الدولة مكلفة بالتشريع والرقابة على النشاط الحكومي تتوفر على مجموعة من الآليات الأدوات الدستورية والقانونية ما يمكنها من أن تلعب دورا مهما في هذا المجال.

تختلف درجة تأثير السلطة التشريعية في رسم السياسة الخارجية من دولة لأخرى حسب طبيعة النظام السياسي والتطور الديمقراطي في المجتمع ومكانة السلطة التشريعية داخل هذا النظام وإدراك النواب لمهامهم ومسؤولياتهم واهتمامهم بهذا المجال.

تتوفر السلطة التشريعية في الجزائر منذ تبني نظام التعددية الحزبية والانفتاح الديمقراطي على مجموعة من الآليات والأدوات الدستورية والقانونية والمكانة اللائقة التي تمكنها من القيام بهذا الدور على أكمل وجه لكنها لحد الأن لم تستغلها بالشكل المطلوب والفعالية اللازمة. Le rôle central et fondamental du pouvoir exécutif dans l'élaboration de la politique étrangère ne nie pas le rôle du pouvoir législatif et son influence dans ce domaine vital et sensible dans le but de la réalisation des objectifs de la politique étrangère et sa promotion pour servir l'intérêt suprême de l'Etat. Le pouvoir législatif, en tant qu'institution officielle de l'?tat, en charge de la législation et du contrôle de l'activité gouvernementale, dispose d'un ensemble de mécanismes et d'outils constitutionnels et juridiques qui lui permettent de jouer un rôle important dans ce domaine.

Le degré d'influence de l'autorité législative dans l'élaboration de la politique étrangère varie d'un pays à l'autre en fonction de la nature du système politique, du développement démocratique de la société, de la place de l'autorité législative au sein de ce système et de la conscience des députés de leurs missions et responsabilités ainsi que de leur intérêt pour ce domaine.

Le pouvoir législatif en Algérie dispose, depuis l'adoption du multipartisme et de l'ouverture démocratique, d'un ensemble de mécanismes et d'outils constitutionnels et juridiques et d'une position adéquate qui lui permet de jouer pleinement ce rôle, Cependant, jusqu'à présent, il ne les a pas exploités de manière adéquate et avec l'efficacité nécessaire.

The central and fundamental role of the executive branch in making foreign policy does not deny the role of the legislative branch in monitoring and influencing this vital and sensitive area with the aim of achieving the objectives of foreign policy and promoting it to serve the supreme interest of the State. The legislative authority, as an official institution of the state, occupies an important position in the political system, in charge of legislation and oversight of government activity, has a set of mechanisms and constitutional and legal tools that enable it to play an important role in this area.

The degree of influence of the legislative authority in making foreign policy varies from one country to another depending on the nature of the political system, the democratic development of society, the position of the legislative authority within this political system, and the awareness of MPs of their tasks and responsibilities as well as their interest in this field.

Since the adoption of the multiparty system and democratic openness, the legislative authority in Algeria has a set of constitutional and legal mechanisms and tools and an appropriate status that enable it to perform this role optimally. However, so far, it has not utilized them adequately and with the necessary effectiveness.
