حفظ الأمن الجماعي في ميثاق الأمم المتحدة وإشكالية توسع مفهوم الأمن

Abstract

حدث هناك تحول تدريجي في الاعتراف بمجموعة من القضايا المتنوعة التي تتجاوز القضايا العسكرية كتهديدات أمنية لمجموعة من الفواعل تتجاوز الدولة كفاعل أساسي، إن هذا الاعتراف كان مقبولا من الناحية النظرية ووسط الأكاديميين والباحثين المختصين في مجال الدراسات الأمنية لكن آثار هذا التحول على القانون الدولي مزال محل دراسة، حيث شكل تحديا كبيرا خصوصا لنظام الأمن الجماعي بصفته الهيئة التي تسعى إلى حفظ السلم والأمن الدوليين. تهدف هذه الأطروحة إلى دراسة إشكالية أساسية تتعلق بقدرة وكيفية استجابة نظام الأمن الجماعي في ميثاق الأمم المتحدة ومجموعة القوانين التي يقوم عليها إلى توسع مفهوم الأمن. توصلت هذه الدراسة إلى نتيجة أساسية مفادها أن نظام الأمن الجماعي شهد تغيرا كبيرا على المستوى العملي في محاولة للاستجابة للتحديات الناتجة عن توسع مفهوم الأمن، لكن من الناحية النظرية بقي ثابتا حيث يمكن إعادته إلى بدايته الأولى ويتضح ذلك من خلال العودة إلى ميثاق الأمم المتحدة. هذا الوضع اثار جدلا واسعا دفع البعض إلى البحث عن بدائل لهذا النظام. There has been a gradual shift in the recognition of a variety of issues that go beyondmilitary issues as security threats to a range of actions that go beyond the State as an essential actor. This recognition wasaccepted in theory and amongacademics and researchersspecializing in security studies, However, the effects of this shift on international law are stillbeingexamined, posing a particularlysignificant challenge to the collective security system as it is considered the body whichaim at maintaining international peace and security. This thesisaims atstudying a fundamentalproblematicwhich is concerned with the capacity of the collective security system and the wayitresponds in the Charter of the United Nations. Besides, it is alsoaimed at studying the body of laws thatthe collective security system depends on to expand the concept of security. This study came to the basic conclusion that the collective security system has undergone a significant change at the practicallevel in responding to the challenges posed by the expansion of the concept of security, but in theoryit has remained the same as it is reported by the Charter of the United Nations. This situation has causedwidespreadcontroversy that has led to seek alternatives to this system.

Il y a eu un changement graduel dans la reconnaissance d’une variété de questions qui vont au-delà des questions militaires comme les menaces à la sécurité à un éventail d’actions qui vont au-delà de l’État en tant qu’acteur essentiel. Cette reconnaissance a été acceptée en théorie et parmi les universitaires et les chercheurs spécialisés dans les études de sécurité, mais les effets de ce changement sur le droit international sont encore à l’étude, Il s’agit d’un défi particulièrement important pour le système de sécurité collective, car il est considéré comme l’organe qui vise à maintenir la paix et la sécurité internationales. Cette thèse vise à étudier une problématique fondamentale qui concerne la capacité du système de sécurité collective et la façon dont il répond dans la Charte des Nations Unies. En outre, il vise également à étudier l’ensemble des lois dont dépend le système de sécurité collective pour élargir le concept de sécurité. Cette étude est arrivée à la conclusion fondamentale que le système de sécurité collective a subi un changement significatif au niveau pratique pour répondre aux défis posés par l’expansion du concept de sécurité, Mais en théorie, il est resté le même que ce qui est rapporté par la Charte des Nations Unies. Cette situation a provoqué une controverse généralisée qui a conduit à chercher des alternatives à ce système.
