| Abstract: | تتناول هذه الدراسة موضوعاً حيوياً وبالغ التعقيد يتمثل في تقييم مسار حقوق الإنسان في الجزائر، من خلال تتبع جدلية التفاعل بين المرجعية الدولية (الاتفاقيات والصكوك العالمية والإقليمية) والواقع الدستوري والميداني (الممارسة الوطنية). وتتبلور الإشكالية المركزية للبحث في قياس وتقييم حجم "الفجوة" بين التكريس الدستوري المتقدم للتشريعات الحقوقية ومصادقة الجزائر على المواثيق الدولية من جهة، وبين تعقيدات الممارسة الوطنية في ظل التحديات السياسية والأمنية الاستثنائية التي عاشتها البلاد خلال الفترة الممتدة من 1989 إلى 2012 من جهة أخرى. وللإجابة على هذه الإشكالية، اعتمدت الدراسة على تكامل المنهجين التاريخي والتحليلي، حيث استُهل البحث بتفكيك الإطار المفاهيمي والنظري لحقوق الإنسان وتتبع آليات حمايتها ضمن منظومة الأمم المتحدة والتنظيمات الإقليمية. ثم انتقلت الدراسة لتحليل التطور القانوني والمؤسساتي في الجزائر، مبرزةً الانتقال المفصلي من مرحلة الأحادية الحزبية (التي غلّبت البعد الإيديولوجي) إلى دستور 1989 الذي أسس للقطيعة الديمقراطية والتعددية السياسية وأقر صراحة بسمو المعاهدات الدولية. كما سُلط الضوء بشكل معمق على ارتدادات الأزمة الأمنية وإعلان حالة الطوارئ (1992)، وتأثير هذه الظروف الاستثنائية على ممارسة الحريات العامة، فضلاً عن تتبع مسار تطور الآليات الوطنية لحماية حقوق الإنسان (بدءاً بالمرصد الوطني، مروراً باللجنة الاستشارية، وصولاً إلى مساعي التوافق مع "مبادئ باريس"). وخلصت الدراسة إلى استنتاج جوهري مفاده أن المشرع الجزائري قد حقق قفزة نوعية على مستوى "المأسسة" و"الدسترة"، عبر تبني ترسانة تشريعية تتماشى مع المعايير الدولية، إلا أن الممارسة الميدانية ظلت متأثرة بضغوط الظروف الاستثنائية وتغليب الهاجس الأمني. مما يؤكد أن الارتقاء بحقوق الإنسان يتطلب إرادة سياسية تتجاوز حدود الانضمام النظري للنصوص، لتصل إلى التفعيل الصارم لضمانات دولة القانون واستقلالية القضاء، بغية ردم الهوة بين النص القانوني والواقع المعاش. Study Title: Human Rights in Algeria Between International Conventions and National Practice (1989 – 2012). This study addresses a vital and highly complex subject represented by evaluating the trajectory of human rights in Algeria. It traces the dialectical interaction between international reference frameworks (global and regional conventions) and the constitutional and practical reality (national practice). The core problematic of the research revolves around measuring and assessing the “gap” between the advanced constitutional enshrinement of human rights and Algeria’s ratification of international treaties on one hand, and the complexities of national practice amidst exceptional political and security challenges from 1989 to 2012 on the other. To address this problematic, the study relied on the integration of historical and analytical approaches. The research commenced by deconstructing the conceptual and theoretical framework of human rights and tracing their protection mechanisms within the UN and regional systems. The study then transitioned to analyze the legal and institutional evolution in Algeria, highlighting the pivotal shift from the single-party era (which prioritized ideological dimensions) to the 1989 Constitution, which established democratic pluralism and explicitly acknowledged the supremacy of international treaties. Furthermore, the study profoundly examined the repercussions of the security crisis and the declaration of the state of emergency (1992), assessing their impact on public freedoms. It also traced the evolution of national human rights protection mechanisms (starting from the National Observatory, through the Advisory Commission, leading to efforts to comply with the “Paris Principles”). The study concluded with a fundamental finding: the Algerian legislator has achieved a qualitative leap in terms of “institutionalization” and “constitutionalization” by adopting a legislative arsenal in line with international standards. However, practical implementation remained heavily influenced by the pressures of exceptional circumstances and security priorities. This underscores that elevating human rights requires a genuine political will that transcends the mere theoretical ratification of texts, aiming for the strict enforcement of rule-of-law guarantees and judicial independence to bridge the gap between legal texts and lived reality. |
