Abstract

الهجرة ظاهرة إنسانية قديمة تعكس حركة الأفراد بحثًا عن حياة أفضل؛ وموضوع الهجرة غير النظامية في المنطقة الأورومغاربية يمثل تحديًا كبيرًا، بحيث تعاني الأطر القانونية في أوروبا والدول المغاربية من قصور في إدارة ملف الهجرة. بين عامي 1999 و2017، أثرت الهجرة بشكل كبير على العلاقات الأورومغاربية، حيث ركزت السياسات الأوروبية على ضبط الحدود ومنع الهجرة غير النظامية، وتحملت أوربا أعباء إضافية دون تحقيق توازن في الحقوق. على الجانب المغاربي، شكلت الهجرة تحديًا مزدوجًا بين كونها مصدرًا لتحويلات مالية وبين ضغوطها على البنية التحتية والخدمات. رغم الجهود لتعزيز التعاون بين الطرفين الأوربي والمغاربي، ظلت العلاقة مختلة لصالح الجانب الأوروبي، مما أدى إلى انتهاكات لحقوق المهاجرين وغياب مسارات قانونية آمنة. ومع استمرار عدم الاستقرار السياسي والأمني، لا تزال الحاجة قائمة لإعادة النظر في السياسات الحالية وتبني نهج شامل يحترم حقوق الإنسان، ويضمن التوازن بين الأمن والتنمية المستدامة في الظفتين.Migration is an ancient human phenomenon that reflects the movement of individuals in search of a better life. The issue of irregular migration in the Euro-Maghreb region represents a major challenge, as the legal frameworks in both Europe and the Maghreb countries suffer from shortcomings in managing migration. Between 1999 and 2017, migration had a significant impact on Euro-Maghreb relations. European policies focused on border control and preventing irregular migration, with Europe bearing additional burdens without achieving a balance in rights. On the Maghreb side, migration posed a dual challenge — as a source of financial remittances on the one hand, and as a pressure on infrastructure and public services on the other. Despite efforts to enhance cooperation between the European and Maghreb sides, the relationship remained imbalanced in favor of the European side. This led to violations of migrants' rights and the absence of safe legal pathways. With ongoing political and security instability, there is still a pressing need to reconsider current policies and adopt a comprehensive approach that respects human rights and ensures a balance between security and sustainable development on both shores.La migration constitue un phénomène humain ancien, intrinsèquement lié aux dynamiques de mobilité des individus en quête d’amélioration de leurs conditions de vie. Dans ce cadre, la migration irrégulière au sein de l’espace Euro-Maghrébin s’impose comme un enjeu majeur, révélant les limites des cadres juridiques et institutionnels tant en Europe que dans les pays du Maghreb en matière de gouvernance migratoire. Au cours de la période 1999–2017, les flux migratoires ont exercé une influence significative sur les relations Euro-Maghrébines, dans la mesure où les politiques européennes se sont principalement orientées vers une logique sécuritaire, axée sur le contrôle des frontières et la prévention de la migration irrégulière, entraînant une externalisation croissante de la gestion migratoire. Cette approche s’est accompagnée d’une prise en charge accrue des coûts par les États Européens, sans pour autant garantir un équilibre effectif en matière de droits et de responsabilités. En parallèle, les pays du Maghreb ont été confrontés à une double contrainte: d’une part, la migration constitue une source importante de transferts financiers contribuant au développement économique; d’autre part, elle engendre des pressions considérables sur les infrastructures nationales et le service public. Malgré les initiatives visant à renforcer la coopération Euro-Maghrébine, les relations demeurent structurellement asymétriques, au bénéfice du partenaire européen. Cette asymétrie se traduit notamment par la persistance de violations des droits fondamentaux des migrants, ainsi que par l’insuffisance de voies légales et sûres de migration. Dans un contexte marqué par la continuité de l’instabilité politique et sécuritaire, la nécessité de repenser les politiques migratoires apparaît incontournable. Une approche intégrée, fondée sur le respect des droits humains, la coresponsabilité et l’articulation entre impératifs sécuritaires et objectifs de développement durable, s’avère essentielle pour instaurer un équilibre durable entre les deux rives de la Méditerranée.
